In these terms and conditions, PartyIgloos, their sub-contractors and agents are referred to as the Company. The signatory to the contract of hire is the Hirer. The following terms and conditions apply to the hire of any item including domes and any other piece of equipment. By booking our services you are in agreement and understand our terms and conditions.
1. CONTRACT OF HIRE
These terms form part of the hirer’s “contract of hire” with the Company. By signing the “contract of hire” the Hirer agrees to be bound by these terms.
2. BOOKING
Your booking is confirmed once you have submitted your booking form, your deposit has been received and we have issued you with a written acknowledgment of your booking.
3. PERIOD OF HIRE
The period of hire is the period which the dome or equipment is required to be ready and available for use. This is detailed in your booking form.
Set-up and set-down times will be confirmed with you the week prior to your booking via email and will be between 07:00-11:00am. Should you have a specific request for a time outside of this slot you must make this clear at the point of booking. We will do our best to accommodate requests but can not guarantee them due to multiple bookings in a day.
4. SITE
All bookings are subject to an agreement that the site is, a minimum of 3.7m in diameter, sufficiently level, and is reasonably firm ground, with access for set-up and that no drainage, electric cables or other services are buried beneath the surface or overhead. The hire charges do not include any making good or repairing of damage to site. The Hirer or a representative is requested to attend site to confirm the position in which the dome(s) or equipment are to be erected. Otherwise, the contract shall be deemed to have been completed once the Company has positioned the dome(s) or equipment as it sees fit.
5. ELECTRICITY
It is the Hirers responsibility to ensure there is a safe electric supply to the dome(s). PartyIgloos will take no responsibility with the delivery and distribution of power to the dome(s).
The dome(s) must be within 30m of the electric supply for the extension cable provided.
6. WIFI
For the Cinema option package Wi-Fi is required to connect the TV to streaming services such as Amazon Prime and Netflix. It is the Hirers responsibility to provide Wi-Fi within range of the dome(s).
6. WIND
If on hot days the Hirer wishes to roll up or fold back the dome walls, then before leaving the dome unattended or in the event of high winds, the walls must be put back securely (including re-attaching the securing loops to the base of the walls).
7. PAYMENT
A deposit of £75.00 is payable on booking and the balance is due no later than 14 days before the period of hire commences. Payments can be made by BACS. If payment is not made within the stipulated times frames, PartyIgloos reserves the right to cancel your booking and retain your deposit. Hire goods will not be released until the balance payment is made in full.
8. CANCELLATION OR PREMATURE TERMINATION OF CONTRACT
Cancellation up to 14 days before the beginning of the hire period is subject to a cancellation fee of 50% of the total booking. In the event of the termination of the contract by the Hirer within 14 days of the hire period, the Hirer shall be liable to pay the hire charge in full.
9. LOSS OR DAMAGE
During the period of hire, the Hirer shall be responsible for the maintenance and safe custody of the Company’s equipment. Other than fair wear and tear or damage caused by an act of God, the Hirer will make good to the Company all loss or of damage to the Company’s property or equipment hired or used on the site. Any damage include stains will be charged for at £350.00.
10. LIABILITY TO THIRD PARTIES
The Company carries £5,000,000 public liability insurance. However, the Company will not be responsible for and the Hirer will indemnify the Company against, all claims for the injury to persons or loss or damage to property.
11. ERECTION AND DISMANTLING
The Company will provide labour for the erection and dismantling and the cost thereof is included in the hire charges. Set up dates and times are weather dependent and will be confirmed in advance of the commencement of the hire period.
You must have the site available and in a suitable condition for the erection of the equipment at the time stated for delivery. You should either be available personally or have a representative available at the site at the time stated for delivery to check equipment delivered and sign the appropriate Delivery Note. If you are not present and do not have a representative at the site at the time of delivery:
a. You will be deemed to have accepted delivery of the items specified in the Delivery Note
b. We will erect the dome(s) in such a manner and location as we consider appropriate provided that we shall follow in so far as possible any plan supplied by you.
c. If you require us to move any domes already erected for any reason which is not our fault, you will be liable for an additional charge.
d. All equipment hired remains at all times the sole property of PartyIgloos. You may not sub-hire or part with possession of the equipment and you may not allow any lien or encumbrance to be created over the equipment.
12. ATTENDANCE
Unless the Hirer elects to have our onsite event service, the hire charges do not include attendance by the Company’s personnel except during the actual processes of erecting and dismantling the dome(s).
13. PERMITS
The Hirer is responsible for giving notice to or obtaining from any authorities who are or may be concerned and must make application where necessary to the Planning Authority, District Surveyor, Police, Fire Brigade and any similar authority or organisation.
14. FORCE MAJEURE
While every effort will be made by the Company to carry out any order accepted, the full performance of it is subject to variation or cancellation by the Company consequent upon an Act of God e.g. fire, flood, storm or gale.
15. MODIFICATION OF CONTRACT
No verbal representations or arrangements are recognised by the Company and these terms and conditions can only be modified by a supplementary written booking form (or confirmatory email).
If for reasons beyond our control any item of equipment booked is not available for the period of hire, we reserve the right to substitute an alternative to meet, as near as possible, your requirements. If we do so you will not have any claim against us. In the event that we cannot substitute suitable alternatives we shall notify you of cancellation of the contract in which event any deposit or other monies paid by you will be refunded immediately, but otherwise no claim shall lie against us.
16. CARE OF EQUIPMENT
a. You are responsible for and shall indemnify us against any loss of or damage to all hired equipment whatsoever the cause.
b. It is the Hirers responsibility to arrange insurance in their name for the hired equipment.
c. Given the risk of damage to a dome(s) in windy conditions you must take all reasonable precautions to ensure that all openings are firmly closed when not in use and are open only for the purposes of entering and leaving.
d. All heating must not be left unattended whilst in use. There must be no heating or cooking within the dome other than by electrical appliances supplied by PartyIgloos. Barbeque equipment or open fires used outside must be placed a minimum of fifteen feet from the dome.
e. All cutlery, plates and glassware must be washed and dried ready ahead of the collection of the domes(s).
